Terms of Use
Effective Date: October 1, 2026
These Terms of Use (“Terms”) govern your access to and use of the website at https://wefixyourfeet.com (the “Site”), operated by Foot Health Center Merrimack Valley (“Foot Health,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms and our Privacy Policy [insert hyperlink], which is available on the Site. If you do not agree, do not use the Site. We may revise these Terms by posting an updated version on the Site. The “Effective Date” above indicates when these Terms were last updated. Your continued use after updated Terms are posted means you accept the revised Terms.
Access to the Site
You may browse the Site without registering. Some features or services may require you to provide information or follow additional instructions. We may change, suspend, or discontinue any part of the Site at any time.
Use of the Site and Intellectual Property
The Site and its content, including text, images, photographs, graphics, logos, descriptions, and their selection and arrangement, are owned by or licensed to Foot Health and are protected by intellectual-property laws. The Site is provided for personal, noncommercial informational use. You may view and print a reasonable number of pages for your personal use, but you may not reproduce, modify, distribute, publicly display, create derivative works from, or commercially exploit Site content without our prior written permission, except as permitted by law.
All trademarks and service marks displayed on the Site belong to Foot Health or their respective owners. No ownership or other proprietary rights are transferred to you by your use of the Site.
Acceptable Use
You agree to use the Site only for lawful purposes and in accordance with these Terms. You may not: (a) interfere with or disrupt the Site or its servers or networks; (b) attempt to access accounts, systems, data, or portions of the Site for which you are not authorized; (c) introduce malware or other harmful code; (d) use the Site to violate another person’s rights or applicable law; or (e) use automated means to scrape, copy, or access the Site in a manner that burdens or disrupts it.
Do not use the Site while driving or when doing so would put you or others at risk. We may restrict or suspend access where we reasonably believe these Terms have been violated or the Site’s security or operation is at risk.
Medical Information; No Provider-Patient Relationship
The Site and its content are for general informational purposes only. They are not medical advice, diagnosis, or treatment, and are not a substitute for an examination or consultation with a qualified health care professional who knows your individual circumstances. Do not disregard or delay seeking professional medical advice because of information on the Site. Do not use the Site to diagnose or treat a health condition.
Use of the Site, or communication with Foot Health through the Site, does not by itself establish a provider-patient relationship. A provider-patient relationship is established only through Foot Health’s usual intake and care processes. The Site is not a patient portal or a channel for urgent or emergency care. Do not submit detailed medical, insurance, or other sensitive information through a general website contact feature unless the feature is specifically designated for that purpose.
DO NOT USE THE SITE OR CONTACT US THROUGH THE SITE OR EMAIL FOR A MEDICAL EMERGENCY. CALL 911 OR YOUR LOCAL EMERGENCY ASSISTANCE NUMBER.
Communications and Appointments
If you provide contact information through the Site, we may use it to respond to your inquiry or request. A website inquiry or appointment request is not confirmation that an appointment has been scheduled; please wait for confirmation from our office. Do not include time-sensitive or emergency information in a website message. Providing a telephone number does not, by itself, enroll you in marketing text messages. Any marketing texts or calls requiring consent will be made only as permitted by applicable law and subject to the consent you provide; you may opt out of marketing communications using the instructions provided with them.
Site Availability and Accuracy
We may update Site content from time to time, but we do not promise that the Site or any content will always be available, current, complete, or error-free. The Site may be unavailable or interrupted for maintenance, technical issues, or reasons beyond our control. We may correct or change content at any time without notice.
Third-Party Websites
The Site may contain links to third-party websites or services for convenience. Those websites and services are not controlled by Foot Health, and we are not responsible for their content, availability, security, or practices. A link does not imply our endorsement. Your use of a third-party website is subject to that third party’s terms and privacy practices.
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FOOT HEALTH DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE SITE WILL BE SECURE, UNINTERRUPTED, OR FREE OF ERRORS OR HARMFUL COMPONENTS. The medical-information disclaimer above is part of these Terms. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOOT HEALTH AND ITS OWNERS, EMPLOYEES, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, GOODWILL, OR PROFITS, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE OR ITS CONTENT. This limitation applies regardless of the legal theory and even if we have been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability arising from the provision of health care services to the extent such liability is not lawfully waivable.
Indemnification
To the extent permitted by applicable law, you agree to be responsible for losses and reasonable expenses (including attorneys’ fees) arising from your unlawful use of the Site, your material violation of these Terms, or your infringement of another person’s rights. This provision does not require you to indemnify Foot Health for Foot Health’s own negligence, willful misconduct, or other liability that cannot lawfully be shifted to you.
Governing Law and Jurisdiction
These Terms and any dispute arising out of or relating to the Site or these Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any such dispute shall be brought exclusively in the state courts located in Essex County, Massachusetts, or, if federal subject-matter jurisdiction exists, in the United States District Court for the District of Massachusetts. You and Foot Health consent to the personal jurisdiction of those courts and waive objections to venue there, to the extent permitted by law.
General Terms
These Terms and the Privacy Policy available on the Site constitute the entire agreement between you and Foot Health concerning your use of the Site, except for any separate agreements governing health care services or other services. If a provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a reorganization, merger, or transfer of the relevant business, subject to applicable law. Provisions that by their nature should survive termination will survive your cessation of Site use.
